Terms of Service for Workshow

WORKSHOW END USER LICENSE AGREEMENT (TERMS OF SERVICE) Effective Date: October 22, 2025. This End User License Agreement and Terms of Service (“Agreement”) governs your use of the Workshow mobile application (“App”) and related services (collectively, “Workshow” or “the Service”). By downloading, installing, or using Workshow, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree to these terms, do not download or use the App. This Agreement constitutes a legally binding license between you (“User”) and Workshow (“we,” “us,” or “our”), setting out your rights to use the App and the conditions that apply to your use of it.

1. Who Can Use Workshow

You must be at least 13 years old to use Workshow (or the minimum age required by the laws of your country).

2. Your Account

To use Workshow, you will sign in with your Apple ID. You are responsible for any activity that occurs in your account and for keeping your device secure.

3. Your Content and What You Own

You own the photos and content you upload to Workshow. We don't claim any ownership of them.

To operate and provide the service to you, you grant Workshow a limited, non-exclusive, worldwide, royalty-free license to use, host, process, store, display, and create derivative works from your content. This license is for the limited purpose of operating, developing, providing, and improving Workshow and its underlying technologies, which includes training our algorithms and machine learning models.

You are responsible for the content you upload and must ensure you have the necessary rights to share it.

4. How to Use Workshow

Workshow and its technology are owned by us and are protected by copyright and other laws. We grant you a limited, non-transferable license to use the app for your personal and business purposes.

We ask that you use our service responsibly. You agree not to:

  • Upload any content that is illegal, harmful, or infringes on the rights of others.
  • Attempt to reverse-engineer, decompile, or disassemble the app or its underlying technology.
  • Disrupt, interfere with, or attempt to gain unauthorized access to the service, servers, or networks.
  • Use automated systems (including bots, scripts, or other tools) to access the service in a manner that sends more requests than a human could reasonably produce in the same period.
  • Abuse, harass, threaten, or violate the legal rights of others.
  • Circumvent any rate limiting, security measures, or access controls.
  • Conduct security testing or vulnerability scanning without our prior written consent.
  • Resell, sublicense, or otherwise redistribute the app or service.
  • Use the service in any way that could damage, disable, overburden, or impair our infrastructure.

We reserve the right to monitor usage and enforce these Terms, including through rate limiting, warnings, suspension, or termination of accounts that violate these rules.

5. Our Pairing Feature

Workshow uses an algorithm to automatically create "before/after" pairs from your photos. This process is automated and the results are provided on an "as is" basis. They may sometimes be incomplete or inaccurate.

6. Subscriptions and Payments

Free Trial

Workshow offers a free trial period. During the trial, you have full access to all features. Your trial period begins when you first sign up.

Paid Subscription

After your trial ends, continued access to certain features (including automatic photo pairing) requires a paid monthly subscription. The subscription price will be displayed in the app and during the purchase flow, and may vary by region or currency.

Payment and Auto-Renewal

Subscriptions are managed through your Apple ID and are subject to Apple's Terms of Service. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial subscription periods.

Refunds

All purchases are subject to Apple's refund policy. To request a refund, please contact Apple Support directly. We do not have access to or control over Apple's billing system.

Changes to Pricing

We reserve the right to change subscription pricing. If we increase the price for your subscription, we will notify you in advance, and the new price will apply to your next billing cycle after the notice period.

Access After Cancellation

If your subscription ends or is cancelled, you will lose access to subscription-only features (such as automatic photo pairing). However, you will retain access to photos you have already uploaded and any pairs that were created during your subscription period.

7. Disclaimers and Liability

Workshow is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties and conditions that are not expressly set out in these Terms.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any legislation which cannot lawfully be excluded or limited. This may include the Australian Consumer Law, which contains guarantees that protect the purchasers of goods and services in certain circumstances.

To the maximum extent permitted by law, our liability for any breach of such a guarantee is limited, at our option, to: (a) in the case of services, the resupply of the services or payment of the cost of having the services supplied again; and (b) in the case of goods, the replacement of the goods or the supply of equivalent goods, or the repair of the goods.

8. Termination

You are free to stop using Workshow at any time. We reserve the right to suspend or terminate your access to the service, with or without notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, our business, or third parties.

This includes but is not limited to: abuse of our API or infrastructure, automated abuse, security violations, or attempts to disrupt the service. Upon termination, your license to use the app will end, and we may delete your account and content in accordance with our data retention policies.

In cases of serious violations, we may terminate your account immediately without prior warning.

9. Data Retention and Deletion

You have the right to delete your account. This can be initiated from within the app (Settings / Data controls / Delete account) or by contacting us at hello@workshow.ai. Upon receiving a deletion request, your data is permanently and immediately deleted from all our systems. We may retain certain information only if required by law or for legitimate business purposes, such as for security or fraud prevention. For more details, please review our Privacy Policy.

10. Updates to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you. Your continued use of Workshow after the changes become effective means you agree to the new Terms.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes.
